    Hello All,

    Experts need your advice.

    My I-94 and stamped Visa is valid till June 2019 from Company A. Comp B filed for H1B transfer and I joined it during second week of Nov'2017 with the receipt copy.However now I have got RFE on the transfer case which needs to be responded. I cannot go back to Comp A irrespective of any circumstances due to no rehiring policy. What are my options for below;

    1. What if the transfer is denied.Can Comp B refile the petition.Or I have to leave the country asap.
    2. With a denial can any other employer file transfer of my petition and will i be able to stay in USA since my I-94 is still valid till June 2019.

    What was the RFE about? You will have 60 days of grace period if something happens with your H1-B. You can find another job or your employer can try to re-file.

    This is true in your case because you have an valid I-94. This is based on the new rule which was created by Obama EO.
