i94 extension on H1 on new pawssport

Hi All,

My H1 is valid until 2020 July. But since my passport is going to expire in April 2018, when I entered the US in Sept 2017, i got i-94 stamped only until April 2018.
Now, I'm applying for a new passport and then want to get my i94 stamped/renewed on my new passport.
Should i cross the border with my new passport or should i ask my company to file i-539? Which one is safer, considering current circumstances?
Also, what is the current processing times for i-539?

Suggestions would be highly appreciated.

Hi,

I think you need to ask your Employer to file the I-94 extension after you get your new passport.
You need NOT cross the border with the new passport.
You can stay in US and get your extension filed and approved.
It might take about 4-8 months for the extension approval.
