Hi,
Could any one please let me know if there are any options to stay or come back to U.S after H1B denial. Here is my current situation.
My H1B Extension got denied on 12/15/2017(I-94 expired on 09/30/2017) due to insufficient letters between Client and Vendor. Before one week of denial, I got a new project(with same vendor). My employer has submitted a new H1B Ext. application on 12/28/2017 with new client on premium processing.I am waiting for the decision from USCIS.If I get the approval, I need to leave the country and then attend for visa stamping.
If in case my H1B is denied again, what are the options that I have to return back to U.S? Am I eligible to apply for F1 visa again. I have come to know that in this case I need to go to India to get the F1 visa. But what are the chances of getting F1 visa again ?
Till how many days I can stay in U.S after H1B is denied(or after I-94 has expired)? Do I need to leave U.S immediately after H1B is denied?
Appreciate you help!
Thanks,
Sandeep
