I am currently working for employer A on H1B (first 6 months were on OPT) since 13 months. I have been paid all my salary (I am in an exempt position) and have all my pay stubs. So that is NOT an issue. I got and accepted an offer from employer B and they have already received my notice of receipt for change of employer petition on my H1. So the H1B trasnfer should go smoothly.
However, with employer A, I had a cointract (when they filed for my H1 in september last year) ) which stated that if I voluntarily leave employer A within 24 months of date of hire, I will have to reimburse them for visa processing fees to the extent of $8000.
I have received an email from HR asking for the money. Wanted to know if there is a way out of this.
2) Are such contracts legal in the US?
3) Can employer A cause any problems or sue me for not paying?
I need this info asap and will appreciate any info.
