No salary till SSN??

Hi Friends,

One of my friend came to USA on H1B. He is followed by his wife and 3 year old son. His employer is not paying him salary saying salary cannot be paid till he gets an SSN. is it true? he is working for him from day 1.

I am not aware about H1 laws and procedures. Would appreciate if someone can throw some light on this.

Hi,

Once you get your SSN only the employer can generate the paystub for you, but noway he can say that he cant pay you till you get your SSN. Ask him to give you by way of cheque or cash, bcz it is illegal in US Law by asking a person to work without a salary. I hope you understand and clearly explain him this in detail.

There have been employers who pay the salary for the period employed while the SSN was being processed after the SSN actually gets issued. Until then some allowances can be paid.
