Hi,
When i was in India, my Employer A applied for H1b in April 2016. I came to us on H4 in August 2016. My H1b got approved with consulate process valid from November 2016 to October 2019. But I never applied for H4 to H1b change of status, because of no job offers in hand. I am still in USA on H4 and i94 is valid until Dec 2020. I have recently selected for a job with another employer B. Employer B is going to apply for my H4-H1b change of status as well as H1b transfer in premium processing.
Now I am in a dilemma whether I am eligible to apply for H4 to H1b change of status as well as H1b transfer to new employer B?
Note: i have never been in usa on H1b before. This is my first H1b
