Hi Experts,
Need advice on my wife's legal status in US. My H1B petition and her H4 petition (I797) got approved in May 2017 for next 3 years. She visited India in June 2017 and came back in July 2017. Her earlier stamped visa was valid till that time but got expired in Aug 2017. On CBP website, her I94 shows the valid until date as Aug 2017 only. Also, she has been given Aug 2017 date on port of entry. Can you please guide if her status is legal or not.
FYI, we applied for her driving licence extension in Sept 2017 and they sent it for secondary verification to Homeland security. DHS returned it as legal status and we got the licence extended upto 2020.
