  • L2 to H1 Visa Stamping

    Hi,

    I'm currently working in US on L2(EAD). My company has filed H1 for me. My question is which of the following would be the best for my H1 stamping:

    1) Go back to India for H1 stamping as soon as my H1 petition is approved ?
    2) Go to Canada for H1 stamping as soon as my H1 petition is approved ?
    3) Stay in US and change status to H1 after approved H1 petition becomes effective on Oct 1st. Get my H1 visa stamped when I visit India next time.

    Does Option 3 increase my chance of not getting a 221(g) ?

    How good are my chances if I go for CANADA (Option 2 ) ?

    Would appreciate all help on the above

    If this is your first ever H1B, then Option 3 is the best. At any time if you approach the consulate with proper papers, there is no chance for refusals.
