H1B Visa Transfer when renewal petition is pending
Hi,
I have an H1b visa which got expired on 31-Dec-2017(stayed in the US for 1 year) and have filed for an extension on 12-Sep-2017 but the case is still pending with the USCIS.
Now that I have returned to India i have a few questions :
1. My extension was filed by employer A, what happens if I switch to employer B and employer A revokes the petition ? Will employer B still be able to transfer my visa ?
2. Can I apply for a cap exempt petition from another employer after a period of 1-2 years later ?
3. If my extension gets denied can any employer file for a cap exempt petition within 6 years or will I have to go through the lottery process again ?
I have very less time to decide so a quick response is highly appreciated.
