    hello,
    i have a approval for 2005-06 and my interview is scheduled this june,06. recently i came to know that the company has been blacklisted. and i have not canceled/rescheduled my interview. now i want to forgo my present petition fearing my visa being rejected. i have few Q's

    1. can i transfer my h1b petition to new employer
    2. if not, can i apply for fresh petition with another employer
    3. can i just cancel my interview and wait for new approval(2006-07)

      Hi Man,

      In your case you cant transfer your H1B to new employer since you are in india still. USCIS requires atleast a months paystub in US for transferring the visa, so in your case it is ruled out. What you can do is try to apply for a new H1B through a genuine employer and get it approved and then go for interview. This is not legal advice, just my suggestion.

          There are no legal issues if you appy for a second H1B. H1B transfer may not be possible though. If you cancel your appointment on time, you may be able touse the receipt for one year from the date of issue.
