Folks,
Looking for answers/suggestions:
If one join new employer where they file h1b transfer in regular which could take 7+ months and they start GC process and get i140 approved -
In worst if h1b transfer is denied what would happen?
1. to i140 that is approved?
2. can they file transfer again? since employee has already started working with their client.
Detail case is H1 transfer to new company while remaining 1.5 years on H1B, the new company advised to start on transfer receipt notice so that if in case of RFE its easier to handle (this is EVC) model.
New company is also willling to start perm at beginning of the employment.
Current employer is in also in process to file perm but after 2 months.
TIA.
