Hi, can anyone pls let me know that whether H1B CAP exempt petition can be filed in the below scenario or not:
My extension was filed when I was in US, but due to some reasons I came back to INDIA (my visa is expired now)and now RFE is received for my case. My employer is withdrawing the petition since I am no longer working in d project
So question is will I be able to apply for H1B cap exempt petition in future on my expired petition or not.
