Hi,
I am in H1B visa working for employer ABC and i have a valid visa till Jan-2020. My dependents are currently in India ,they do have valid stamped H4 visa till Jan 2020. I planning to switch to employer XYZ , for which they are working on H1B transfer process for me. My dependents are panning to travel in early June-2018 to USA, at that time i will be still working for employer ABC but by visa transfer request petition would have been submitted by employer XYZ.. My question is, can i file a H4 visa transfer request for my dependents once they are in USA and after i started working for company XYZ and is it mandatory to file that transfers for H4 ? and is it legal for them to stay with old employer H4 ? Appreciate your inputs. Thanks !
