Hello All,
Here is my case. I visited India last year July and came back to US on my old H1 visa valid till July 31. I reached US on July 10th and my i94 was given till July 31, 2017. Meanwhile my H1 extension was pending while i was in India and it got approved on July 5th valid till Dec 2019. which i came to know after my entry to USA.
1. Since i entered US with old visa and have never applied an extension post reaching, will i be considered out of status? I'm not sure if i94 on H1 petition or the i94 on old visa would be considered as latest.
2. Currently i'm planning to travel India for vacation in month of June and do stamping for the extended H1. Will there be any risk while i reenter if i was considered as out of status based on my case. Kindly help.
