I had approved H1B visa which was expired on 30 Sep 2017 but I didn't travel. Later applied for cap exempt. That H1B cap exempt petition got denied. The reason stating "employer employee relationship". Would I be able to apply again for cap exempt immediately? If yes, can I apply from same employer or a different employer.
