I would appreciate any help / advice for my situation. Here it is:
I entered US in 2002 Jan on F1
I changed to OPT on Oct 2003.
Then to H1B from Oct 2004 to 2005.
I got laid off in Nov 2005 and changed my status to H4.
And I have not yet completed my MS. I have my thesis defense to present in order to graduate.
1. If I apply for H1B now ? Will I be subject to cap ?
2. Should I be on F1 visa and complete my Masters in order to apply for H1B through Master's quota ?
3. How can I possibly get H1B without subject to cap ? please advice
