My H1B/I94 expired on 30th June. My current employer filed an extension on 27-June and new employer filed H1B transfer on 28-June. On July 5, received H1B transfer approval with I94 and planning to join the new employer in 25-July.
Now, if I resign from the current employer then my extension petition will be withdrawn. Will I be considered out-of-status for 25 days where I worked for the current employer on receipt notice of extension even if my transfer was filed before visa/I94 expiry and is approved.
Should I wait for the extension to be approved before joining new employer or I can join new employer as H1B/I94 are approved even if later my current employer withdraw the extension petition. Kindly advice.
