  • Consular notification due to delayed filing - question on I94

Cross-posting from another forum for better reach.

Hi experts, I am getting confusing inputs regarding my options, hence need your advice.

My previous job ended on 4/29 but I have valid stamp and I94 till 2020 through that employer - they have not revoked it yet, not that it matters. I got an offer this week, so H1B transfer(premium) will be done as Consular notification since I do not have paystubs since 4/29. But the attorney says I will have to go to India (home country) for new stamping once this petition is approved (without I94). I was of the opinion that new stamping is not needed since I have valid stamp through previous employer - I think I just need to cross the border and get a new I94 on my way back (from my understanding , but attorney not agreeing).

Please comment on whether I need a new stamp for this new H1B or just new I94 by crossing border. Thanks in advance for your inputs.
