I am working for employer A and I have valid I-94 till Aug-20-2018 and H1B extension filed in June-2018 in regular processing. Meanwhile I got another offer from employer B in July 2018 and they applied for my H1-B transfer in premium process on July 28 2018 and I received receipt notice Aug-1-2018.
Now I have below questions as my I94 is expiring very soon.
If H1B transfer is Approved, I am assuming I will get new I94, So I can join Employer B anytime after that. Is it possible that H1B transfer gets approved without I94? If Yes, what are my options?
If H1B transfer gets RFE, Can I join Employer B based on receipt notice even after my current i94 expiry? Let?s say my last day with current employer is 24-Aug(Friday) and Can I join new employer on Aug-27(following Monday)? If Yes, will there be any risk of out of status days?
