I?m currently working with company ABC on L-1B Visa and my current L1 visa will expire in February 2019. This year (FY 2019), my current company ABC filed a change of status petition from L1 to H1B and my case has been picked up in lottery. Also, another company XYZ filed a change of petition this year and my case has been picked up in lottery as well. Both company ABC and XYZ are not related entities.
Currently, both cases are under same status ? Case was received. None of them approved yet. (No RFE as well). I?ve few questions based on my current situation.
1. If both petitions got approved before October 1, can I choose any one company?
2. If petition for company XYZ approved before October 1 and petition for ABC not approved by October 1, can I stay with my current employer ABC on L1 visa till H1 petition approved from my current company ABC?
3. If I?ve to join company XYZ on October 1 and once petition approved from my current company ABC, can I join my current employer again?
Your help in this matter would be greatly appreciated.
