Not sure if I-539 was filed, but I-129 is approved

I do not know if I-539 was filed by my attorney, but my H1B (second term) is already approved. RFE for stamping is asking for approved I-539 (from first term onwards). What can I do? My employer says I797 approval for I-129 that they filed is fine. But I dont want to take any chance.

H-1b doesn't use I-539; it uses I-129. Who is getting a visa?
