H4 to H1 COS

Hi,

I was on visa H4 in the US and hold a H1B visa from my previous employer. A consultancy company filed for my H1B transfer and it has now been approved. But the company is not employing me now since they don't have a position.

So what would be my visa current status since I not employed currently. Am I still on H4 or is my status changed to H1B even if I am currently unemployed.

If your Change of Status was approved, you are on H1b status, as of the date your I-94 starts (your new H1b I-94 came with the approval notice). You might be out of status, if you are not employed.
