Hello,
Here is the situation where I would need little help.
I797 expires on 24th January. This will be the 6th year, So when I apply it will be for 6th year extension. I140 will be applied this week in premium hoping it will be approved without any issues. If H1b extension is applied in January 2nd week in premium as its an extension with same employer and same client and in case of any reason if the case is still not approved past January 24th, will USCIS issue I797B? or will they issue I797A?
Any thoughts would be greatly appreciated
