I have a quick question hoping someone can help me.
Facts:
- PERM filed 365 days before H1b max-out
- I - 140 approved
- PD current
- H1b year 6 expiring September 2019
The only reason my employer has not filed AOS yet is because the PWD is higher than my current salary. I think they want to wait until I reach PWD. I thought I can keep extending my H1-b on the basis of approved PERM/I-140, but I read somewhere that the extensions are only for people whose priority dates are NOT current, and thus they are unable to file the I-485. My date is current, I-140 approved, but I-485 on hold until I make the salary that meets PWD which could be 1 or 2 more raises.
Question: Can I get the H1b extension beyond 6 years even though my date is current but I-485 not filed? Technically, there is no good reason for not filing the AOS.
