My H1 will expire in Feb and extension is pending (RFE received). I have an offer from another employer who is willing to file H1 Transfer before my I 94 expires. I also want to file a H4 COS to be on safe side knowing how things could be delayed when working with big companies.
1. If H1 Transfer is filed in time, can I start working for the new employer on receipt #? Will this abandon my H4COS?
2. Should I get it switched to premium when premium is available so I don’t run into the risk of H4 being approved first?
3. I will file for H4 COS + EAD concurrently can H4 get approved first before EAD? If H1 Transfer is still pending, should that be refiled now to H1 COS or is that application still valid?
