A company has filed for my H1B and it got approved and I scheduled an interview with the consulate. Simultaneously my fiancee has filed for the K1 petition and that got approved as well.
During the interview the Visa officer has asked that I cannot have both visas so I need to choose one. I told her I will choose H1B.
She issued a yellow form and said that she would need me to withdraw the K1 to process this case
My questions are
Will it be good for us to let go of the K1 visa?
Is it best for us to go with the K1 or continue on the H1B path, where we submit the K1 withdrawal document?
What I am thinking is when I said H1B, did it raise a red flag that our relationship might not be bonafide. And does it help if we include in the documentaion that we have decided before teh interview that for us(my fiancee and I) it will be best if I come to the US on H1B so that I can work and then apply for I130
