I am L2 visa holder which depends on my wife L1B visa. My wife's company called her back earlier this year and so I decided to apply H1B. Now the H1B is just approved and I got the notification letter I-797C. However I have decided to go back to my home country at least for several years. I have a toddler who is a U.S. citizen and so I might come back to the U.S. in my long term plan for my child's study. My company wanted me to stay and would like to sponsor me to apply for GC right away after I process the status change from L2 to H1B... Questions:
1, Will my H1B get expired if I don't use it as I stay in my home country?
2, Can I go back to the U.S. to work anytime within this 3 years?
3, Could I apply for GC even though I am not physically in the U.S.?
4, How long would it take to apply for GC (my home country is Hong Kong)?
5, Is that I could apply i-140 at the same time with GC application such that my wife work in the U.S. legally after approval?
