I have a H1B visa with employer A valid until Dec 2020, Employer B filed an visa transfer on Aug 2019 and it recently got denied. Attorney of employer B is saying, we will take the case to court that way we will directly get chance to talk/fight/explain our case to judge as as our petition is very strong and we can fight for our approval. but, I never heard of filing/taking a case to the court against transfer denial infact i heard of appeal and MTR, but attorney says this is different than appeal/MTR. If anyone gone through this situation or have idea on this process please let me know is this a good way to approach?
There will be any further complications on this process?
If judge denied my case will i have to leave the country immediately?
Does this process really work?
I even don't know what kind of category this court case will fall under.
