Hi, my spouse H1 transfer denied today (yet to know the reason) after RFE response, we would like to know the possible options, please check the below and provide me with your inputs inline.
Her I94 with employer A is valid till feb-2020 but she changed to employer B on receipt which got denied today.
Am on H1 with extension pending and I94 expired.
1) Can she continue being in USA and try some other company and the employer can file for a transfer? can she start working with new employer with reciept.?
2) When is her out of status starts from (illegal stay)? the day we receive the denial notice or the day she left the employer A, please confirm, this is very confusing.
4) Does she have to leave the country immediately or can stay for sometime in USA then apply for H1 from different employer once approved she can go to india and come back with visa?
5) Can her current employer file appeal ? is it good to go with that way.? what are chances of approval?
6) Can she convert to H4 (not sure since my H1 and I94 are expired) and apply for H4 EAD?
7) Can multiple employers file her H1 while she is in india? this is jus for safer side.
8) Can she travel to india if any employer files her H1 petition(while she is here) and H1 petition is pending with Uscis?
