In my case ? My max out is on Jun-2019 including all the vacation days and my I-94 expiry date is 12-Feb-2020. Now my I-140 is still in progress (I-140 filed on 10-Dec-2019).
I have following questions, anyone please clarify.
Question 1: With I-140 not being approved still and max out is by Jun-2019 with valid I-94, is it legal to stay in US on or after Jun-2019?
Question 2: In this case can we apply for H1-B extension after max out, if so when it can be applied with the I-94 expiry date as 12-Feb-2020?
Question 3: Converting I-140 from normal to premium process at this point will it help? (With max out date well before the I-94 expiry date and I-140 under progress)
