I am in a tricky situation.
My H1B expires in Dec 2019, but when I moved to a new client in Nov 2018, my employer filed for my H1B extension, amendment and my wife's I-539 simultaneously. I understand that H1B is filed for extension only 6 months or lesser before expiry, but my employer's immigration attorney assured that when there is an amendment, this is fine.
Now I am planning to convert my case to premium. My question is this - In that case can I also file for my H4 EAD renewal right now ? My wife's current H4 EAD is valid til dec 2019. I know the 180 day rule applies for H4 EAD also, but with this amendment also happening at the same time, it is possible to file H4 EAD now like we did for the H1B extension? Please help.
