  • H1B Question

    I stayed in US for 4 years and 4 months and got back to india in May 2006. There are still 20 months remaining on my H1B. I am planning tostay in India for more than one year and then go to US on my existing H1. My question is that will I be allowed to stay in US continuously for next 6 years. I understand that my current H1 will allow me only 20 months. But if I get a new H1 after landing in US, then would I be allowed to continue for 6 India nafter 20 months. Can someone please help answering my query?

    It is the sum of all the H1Bs you have had. If they exceed 6 yrs; you would need to leave the country for a period of atleast 1 yr.

    Since you plan to live in India for a period of 1 yr, and plan to return to the US with a new H1B, you can ask the co. that is applying for your H1B to request the USCIS to credit the 1yr back, which would give you 20 months from the time you enter the USA with the new H1B
