I am in my 6th year on an H1B visa and have filed for my Labor (Perm) through my employer in Feb '06. My current H1 expires end Jan '07.
I have an offer from a company who is willing to transfer an approved Labor to me and help me file for I-140. If I accept this offer, will I be able to apply for my 7th year extension from the new company, based on the Labor transfer and I-140 filing?
The question arises from the fact that I would have spent less than a year (in both cases) since filing for the Labor and want to know if I have both the options available to me for my 7th year H1 extension filing?
