  • Need help urgently about H-1 transfer

    Situation:
    I joined with one consulting company (they don't pay me until I can find a project to work). However, They said that my H1B has already been submitted by them (They deny to give me a tracking number). During the H1B process, I stay in US on my OPT.

    Questions:
    1. How can I check if the current company already filed my H1B case? In this case, they deny to give me a tracking number.
    2. If I can find a new company which offers me H1B and pay me for work, in this case, what H1B process shoud the new company do for me?
    3. Can the new company file a new H1B application for me instead of transferring H1B from a previous company? In this case, I don't have a tracking number to check my H1B status and I am not sure whether or not the previous company already submits a H1B application for me.

    Please help me ASAP!

    There is no other way to find it out. But if the company took the check meant for USCIS from you, then you can see if the check is encashed....that means the H1B has been filed for processing. There is no other way.

    A new employer can file for your H1B, but you will fall under the yearly numeric limitation

      Thank you so much for your useful advise. However, the current company doesn't take any checks from me. So, I wonder if they give me the right information or not.

      Anyway, you said that "A new employer can file for your H1B, but you will fall under the yearly numeric limitation". It means that the quota for H1B in 2007 is out, doesn't it? I'm in Master Degree. Please give me info how I can check the quota status.
