H4 7th year extension

Hi,

I recently had my first H1 extension done. But have not filed for extension of H4 visa for my wife. Lawyer screwed up this by not filing her extension with mine. Now can I file for H4 extension seperately if so any pointers as to what do I need to be careful of.

Has your wife's H-4 status expired?

If so, she is now accruing unlawful presence and you cannot file an extension for someone not in status.

If her staus expired less than 180 days ago, one option is for her to leave the US and obtain a new H-4 visa. If her status expired more than 180 days ago, she should not leave the US and will need to do a nunc pro tunc filing with the Service Center. If she is still in H-4 status, you can file for H-4 extension based on your new H-1B.

Does'nt H4 expires with H1

I got my approval notice in March and lawyer has not filed for H4 extension so far. How much time we have to file H4?

Please let me know other solutions.
