  • h1 Timing issue

    I have completed 4 years on my h1 currently working on h1 extension.

    I am planning to go back for year and again come back.

    I have two questions.

    1. When I will process my h1 after a year will I need to apply against H1 quota cap or i wont have to as i already had h1 approved previously.

    2. When I will come back will my 6 years counter will get reset or I will have to again go back after a year( which is 6th year from my first h1).

    If you leave the US for one year, your new H-1B filing should be counted against the current cap of that time.

    2. When I will come back will my 6 years counter will get reset or I will have to again go back after a year( which is 6th year from my first h1).

    If you leave the US for one year, your total time of 6 years will start over again.

    If you have certain green card paperwork pending, you may be able to extend your H-1B time beyond 6 years.
