4th year (2nd) H1b extension approved only for 1 year

My 4th year (2nd) H1b extension approved only for one year instead of 3 years. My H1B was approved in 2001 Oct, but I'm here in USA only in April, 2003. My employer applied for extension in April 2006 for 3 years. But I got the approval for only one year (Until May 2007). This may be because of some confusion over my actual stay (from 2003 April) in US and approval of my first H1B approval (Which was in October, 2001). My employer claims that he clearly mentioned the period (from June 2006 to June 2009) when he applied. I'm assuming that, INS overlooked the applied date and considered my initial H1B approved date. My attrny tried to resolve this talking to INS since a month, but we have not seen any positive resp as of now.
This is High time for my family to go to INDIA, for the same I'm planning to go for visa stamping in Canada or INDIA.
I need your advice to resolve this, so that I can get 3yrs extension and 3 yrs visa. Your suggestions/advices are highly appreciated.
