H1&B1 rejected

Hi,
My H1 and B1 were rejected @chennai consulate,India

During my H1 visit in AUG 05:

ME:I submitted my file.

VO has seen the employer name n the pettion ,And he asked me to wait,
gone inside and called 2 of the other interviewers and one indian staff .
Those 3 persons are standing behind him an observing.

VO:How much you paid to employer for processing?
ME:Nothing i have paid.
VO:How much you are going to pay once you land in US?
ME:I no need to pay anything,it is a free of cost.I will be paid once i start working.

VO:Can i check your degree certificates?
ME:yes,sir
**** **** **** **** **** **** ***
I have given my originals of BTECH,INTER,SSC.
He has seen my branch as Civil Engineering.
He started discussing with other staff members about the certificates.
In between one more lady joined ,middle aged woman,looks like she is the head of the staff.
He has seen computer programming as one of the subject in the first year marks sheet.

VO:Have you done computer programming in 1st semester?
ME:Ours is not a semester wise sir,we had annual wise .
VO:So you have Computer programming in first year.
ME:Yes sir.
VO:You basically does not qualify to work in US .
ME:I have done CDAC(Center for development of Advanced computing) cource after my BTECH.
Also i am working from last 6 yrear in the field.
VO:Still ,you don`t have computor programming certificate from deemed university.Where are working right now?
ME: I said my current employer name,Bangalore
VO: Can i see the appointment letter from current emploer?

I have given all the docs from current emploer.
He asked one by one all my exp letters,they are seeing all the joining and releaving dates and discussing themselves.

VOid you have xerox copy of your degree certificates?
ME:No sir,I haven`t takes the xerox.
VO:Can i take the xerox of these?
ME:yes sir.I have given my btech certificate and 4 yrs marks cards.

All other members who were standing behind him left.
he went for xerox and came back after 3 min.
He picked up 221(g) form and ticked at the "administrative processing required" option.

VO:Your case requires further administrative processing so,we will communicate with you.
**** **** ****
He gave me 221 (g) form
**** **** **** **** **** **** **
ME:What will be the next process?
VO:We need to verify you degree and also regardiang comdata consulting .
MEo i need to do any thing with this form.
VO:No, you just keep it with you.
ME:How long this process takes?
VO:we will communicate.
ME:Thank you ..

VO: why are you going?
ME: product training.
VO: what does u r current employer services? and what is your role?
ME: i said abt my emploer and the role i play.
VO: what happened to u r H1B?
ME: I assume it has been rejected
VO: Do you know the reason?
ME: may be there is a remark on the consultancy.
vo: Did you asked u r consultancy?
ME: I didn`t get responce.Any way i am not going with that consultancy.
VO: No , you are going on H1B.(I g,uess VO might be refering to the new H1B My new H1 was filed,looks like VO has those details also in their system)

That time i couldn`t understand why she said like that.
Than she took 221 and ticked towards : Not eligible for NON immigrant visa.
ME: R u rejecting B1 because of my H1B rejection?
VO:Yes.
-------i couldn`t understand why she said ,i am not eligible for non immigrant visa.

Can any one help me in this regard as i need to attend H1B interview with the new consultancy.
Your suggestions are appreciated.

I can't answer you on the H concerns you have but you will always face an uphill batttle with a visitors visa because by applying for H visa, you ahve already claerly expressed an intent to work and live long term and possibly permanently in the US. The visitors visa will always ve viwed as an attempt by you to circumvent the process by going in as a visitor and then applying for a H-1b while in the US

No, it doesnt mean you won't get a H-1B ....you can always correct the deficiency and reapply. Your chances of getting a H-1 B are in fact much higher than getting a B Visa

Next time u go to h1b

1) Please try to do some degree releated to computers

2) carry all the xerox that they asked for
