*** I have searched for a lots of threads discussions for the last 2 days but didn't get answer to this one ***
I'm on L1 now for company 'A' and got my H1 approval for company 'B' 2 weeks back. My start date given on the H1 approval notice is Oct 1,2006 ...HOWEVER i want to join the new employer on Oct 15,2005 as I have a good amount of stock options to be realized from my current employer. My questions are ..
(1) Can I legally start working for 'B' from Oct 1,2006 to Oct 14,2006 but still be on the rolls of 'A' ?
(2) If the above is not legal, then Can I go on an unpaid leave from Oct 1 to Oct 14 so that I don't work for neither 'A' nor 'B'. This way, I wouldn't be on payrolls of 'A' during that period AND get my last day at work as Oct 14,2006 and then join 'B' on Oct 15,2006. Is this ok ? Also, will this situation create any issue while I go H1 stamping later or during GC processing ?
(3) Am I considered to be working for 'A' or 'B' for the period Oct 1 to Oct 14, if I go on an Unpaid Leave during this period ?
All suggestions are welcome ..
