    Hi,

    This has happened with my friend.

    Her details as below:

    She has filed H1b with one of the body shopper in USA(name not disclosed). She is offered 60K per annum. Now her h1b is approved by INS and the body shopper has send her the contract document and offer letter which they say will be send to INS.

    The offer letter mentioned 50 K per annum. When she talked with the Body shopper they mentioned that this offer letter is for INS purpose and once she lands in USA she will be given 60K as per discussion.

    My Question:

    1. Why there is this difference in the offer letter for INS and the actual (when she will land in USA)?

    2. Does that mean that her payment will be 50K per annum?

    3. How authentic are these documents once they are send to INS?

    4. Is this fraud? If Yes, what she should do?

    - For the LCA, the employer needs to mention the minimum possible pay as per department of labor, so the employer needs to write a higher pay so the H1 gets approves.

    2. Does that mean that her payment will be 50K per annum?
    - Yes

    3. How authentic are these documents once they are send to INS?
    - Its upto the INS to decide the authenticity of the docs.

    4. Is this fraud? If Yes, what she should do?
    - Almost all body shoppers are fraud. She can easily switch employers once she gets 2 paystubs.
