H1 Transfer-urgent plz

Hi Friends

I am with company A. My tenure is getting completed by Sept 15th. If I have to transfer H1 for another company B, how many days I can have after Sept 15th.

or is it compulsory that I need to apply for transfer before 15th?

Please advise me as i'm running out of time.

---- APPLY immediately for your H1B transfer to another company B or extend your H1B with company A. Do it on a premium processing, else you will be considered to be out of status and you have to leave the USA within 10 days (maximum, in fact you will have 0 days of vslid status if your H1 expires, 10 days is only a grace period) if your H1 expires unless you have a I-94 valid for some more time

---- Yes, it is compulsory that you apply for transfer before 15th. Haven't you read the rules or has your employer not informed you and haven't you reminded your employer about all this? What is the story and what are the facts of your case. You are coming too late to the forum to seek information and you are taking it easy. may be you have already applied for extension/transfer and seeking the advice of the forum as to the next step

Thanks a lot for you response. here is my full story.

1) I was with comapny A. and I applied for H1 transfer with company B.

2) Before I join Company B, I applied H1transfer with company C (on company A papers) and joined company C.

3) Now I am with company C. and visa that I applied with company B is still in process now.

4) Now I have to go out of this company C by Sept 15th.

5) I dont want to go to company B also.

6) So now as company B visa is in process, am I legal to stay even though I dont apply for H1 transfer thro company D again before 15th of Sept.

7) I would like to take some time to get a good opportunity and then apply for H1 transfer with company D.

8) Now in this scenario do I have to compulsorilu apply for transfer with company D before 15th? or can I apply after 15th also?

Please help me in this regard

---- Why do you have to go out of company C by Sept 15th? What is the period of your H1 in this company. Either you are laid off or you have personal reasons

---- OK, If any H1 B transfer is in process you can stay in the country. But you should join company B to ensure that you get pay checks as you have to be paid all the time while you are on H1B. You cannot sit at home and apply for H1 transfers and keep looking for jobs

---- Join company B (like it or not) as you are quitting company C and if you do not work at any company then your status can be questioned

---- As you have already applied for a H1B transfer to company B and hope- fully you have the transfer receipt with you, the transfer to company D can take place after the 15th of Sept. However, you have to be employed and earning pay checks to maintain your status
