  • H1B Laid Off!! Please Help!!

    Hello All,

    I was laid off on Aug 28 and my termination date was Sept 11.I filed for a H1B transfer with a new company. I got the approval notice today that my H1B transfer is approved but the start date on the new H1B approval notice is Oct 2, 2006.

    I want to know if there will be any problem for me if I start on Oct 2 as I am afraid that I will be out of status from Sept 11 to Oct 2.

    Please let me know if this period of no employment will create any problems for me in future. If it does what can I do to avoid it.

    ---- You should be fine. For a period of about 20 days you will be without pay or if the employer has already paid you for this period then you are better off. As long as you have an H1 approval notice and a start date your stay is legal.

    Please confirm this with an attorney for enhanced confidence
