My 6th year on H1b finishes in April 2006. I have I-140 approved but almost 2 yrs away from filing I-485 (due to retrogession). I have a very good offer in a very big Global company. I am seeking help on the following doubts :
1) I already have 3 years extension based on I-140 approval (I originally had visa for 2 + 3 yrs). Would my H1b be transferred for three years if I go ahead with the new offer?
2) Legal in the prospect company had suggested me that they would file my PERM immediately and obtain I-140 approval thereafter. Also, they mentioned that my previous priority date can be used to file I-485 once (they get new I-140 approved + previos priority date is current). Does this makes sense?
Please send in your valuable comments / suggestions. Thanks in advance to everyone.
