I have been in US since May'05 on L1 Visa and I applied H1B visa on Feb'06. I travelled to india on May'06 and returned on June'06. H1B petitioin has been approved on Aug'06 and got approval notice (I-797B) without I-94.
1. Should I go to Visa Stamp before start work or Should I apply for COS?.
2. Any idea about I-797A and I-797B approval notice?
Clause from I-797B approval notice,
"if any of the workers are already in the U.S. the petitioner can file a new Form I-129 to seek to change or extend their status based on this petition"
"This approval of this visa petitioin does not in itself grant any immigratioin status and does not guarantee that the alien beneficiary will subsequently be found to be eligible for a vias, for admission to the united states or for an extension, change or adjustment of status".
Note: No where mentioned, i have to go out-of country and get stamp
