  • Urgent! missing Original Notice of action I129

    Hi

    my petitioner has not got a copy of notice of action I129, however he has a scanned copy of I129. And last update from INS was that the original has been sent to Chennai Consulate and no further copy has been sent to my petitioner.

    1.In this case, what do I need to do? Can I take the printout of the scanned copy of I129 ? will that suffice? If you can explain me the difference between I-797 and I129 it will great...

    I have two more questions regarding Passport as well..sorry to mix up, but please help me understand this..

    2. Address in the passport is not update from College address. Will that be an issue during Visa interview?

    3. ECNR stamping is NO currently and I have not applied for ECNR Stamping "Yes". Will this also be issue during Visa interview.?

    ---- I-797 is the H1 B approval notice that you receive as a document for your employment with the specific employer

    ---- I-129 is the initial application that you use when applying for H1

    ---- That is perfectly fine. The stamp/certificate should say NO as that is what you want. The ECNR is a system for the local govt. (I presume you are referring to Indian Passport)

        ---- Is the petitioner your lawyer or the employer. The petitioner will not get a copy of the I-129. They have to keep a copy by themselves.

        ---- Where are you having this scanned copy from? You say that the petitioner does not have a copy. Assuming that it is from the petitioner yes, surely you can take a print out of the same and present it to the VO if asked.

          Thanks again..

          petitioner is an employer. and the project in in-house not at client.. employer seems to have talked to INS now and understand that INS sent a the approval of notice (I129) to Chennai Consulate directly..
