Hi,
I'm working under H1B visa and my wife filed her 140 and 485 (I'm a dependent). We both got our EAD and AP approved.
I plan to have a travel outside US but I don't know which option is better for me.
1. Apply H1b ouside US to re-enter US
2. Use my AP to re-enter US
I heard that if I use AP, I will lose my H1B status. This is not what I want. But if I re-apply h1b outside of US, can I still use AP in case I'm checked or declined for the h1b visa?
If I choose option 1, what if the Visa Officer doesn't allow me apply for h1b visa because a 485 has been filed for me?
