    Hi,

    I got my status changed from L1 to H1 in 2006. Change of status application for dependents has not yet been processed. Can we travel back to India on vacation and get our visa stamped with the new status? Specially will it be a problem for the dependent visa? What are the documents that I will need?

    Thanks for looking. Any reply will be appreciated.

    ---- If you are going to India for the H4 interview the documents needed from the principal applicant are notarized copy of I-797, Passport pages and other personal documents like your own Passport, proof of marriage etc.

        ---- When you say unprocessed does it mean that you have not applied for H4 while in the US?

        In that case I presume the L2 of your dependents is still valid with an unexpired I-94. If this is the scenario then there whould not be an issue to seek an interview for the H4 Visa, get is issued and return to US

          I have applied for H4 but it is still with USCIS. Sep 14 applications are being processed now. Based on that it will be probably another 2.5 months before mine gets processed. L2 of my dependents is still valid with an unexpired I-94.

          I have already received the approved I129 petition along with other related papers. I will also travel and apply for the visa together. Does that mean that I need the I797 from my employer?

            ---- OK, I understand your issue now. Yes, you can travel to India and appear for H1 and H4 interviews at the same time and date. However, you should have the I-797 from the employer. If the employer does not provide the entire I-797 then the bottom left side portion of your I-797 will have the I-94 and that can be provided to the VO as a proof of the I-797 and after that the VO can access all the information about the I-797 and then of course the questions follow.

            ---- Hope you are able to answer all the questions and get your Visa granted and return to US safely
