H4 to H1 conversion

Hi

I have following questions about H4 to H1 visa conversion.

I was H1 visa holder for year 2006 and came on H4 currently.

1) Do I subject to H1 visa cap if I wish to file for H1 through new employer?

2) Though I was holding H1 visa, it is not stamped on my passport. Does it make any difference?

3) If we visit India while I am on H4, before I convert to H1, will it make any problem (subject to cap) ?
