Hello:
I am in a unique situation.
My H1 visa and wife's H4 visa expired on Jan 15th, 2007.
I have applied for extension and have received notice of action 1797C for my H1 (I-129) and wifes H4(I-539).
Due to current processing times the approval may take 2 months so probably looking around getting approval in mid march.
My wife had to leave for India due to emergency and is currently in india. (I am currently in US).
Can she get H4 stamped before the final approval comes since visa on passport shows expired.
She wants to come back in feb ? Is there any way around it?
