  • Do I really need to extend my H-1B visa?

    Hi there,

My H-1B visa is going to expire on February 2006 and it is going to be beyond 6 years. I know that I can extend another year. My I-140 approved on 10/5/05. I am waiting for my I-485. INS received my I-485 on July 12, 2005.

Do I really need to extend my H-1B visa? Is it true that if I submitted my I-485 to the INS, I do not need to maintain my legal status? Since I have my working permit and I-140, do you think that I should extend my H-1B? I am so cofused and I tried to save some legal fees. Please let me know. Thanks.

You don't really need to extend H1B visa. You can be on EAD/AP.

    However, please read
